Defending the First Amendment in the Court of World Public Opinion

John Kerry, “war hero” (and now “constitutional zero”), wants to swift boat “out of existence” the First Amendment, a/k/a the heart and soul of American liberties and the crown jewel of the US Constitution. Thomas Jefferson, one of the most important founding fathers and third US president condemned official censorship of the type advocated by Kerry and explained with crystal clarity the paramount importance of the right to free speech and press: “The people are the only censors of their governors: and even their errors will tend to keep these to the true principles of their institution. To punish these errors too severely would be to suppress the only safeguard of the public liberty.

The way to prevent these irregular interpositions of the people is to give them full information of their affairs thro’ the channel of the public papers, & to contrive that those papers should penetrate the whole mass of the people. “The basis of our government being the opinion of the people, the very first object should be to keep that right; and 𝐰𝐞𝐫𝐞 𝐢𝐭 𝐥𝐞𝐟𝐭 𝐭𝐨 𝐦𝐞 𝐭𝐨 𝐝𝐞𝐜𝐢𝐝𝐞 𝐰𝐡𝐞𝐭𝐡𝐞𝐫 𝐰𝐞 𝐬𝐡𝐨𝐮𝐥𝐝 𝐡𝐚𝐯𝐞 𝐚 𝐠𝐨𝐯𝐞𝐫𝐧𝐦𝐞𝐧𝐭 𝐰𝐢𝐭𝐡𝐨𝐮𝐭 𝐧𝐞𝐰𝐬𝐩𝐚𝐩𝐞𝐫𝐬 𝐨𝐫 𝐧𝐞𝐰𝐬𝐩𝐚𝐩𝐞𝐫𝐬 𝐰𝐢𝐭𝐡𝐨𝐮𝐭 𝐚 𝐠𝐨𝐯𝐞𝐫𝐧𝐦𝐞𝐧𝐭, 𝐈 𝐬𝐡𝐨𝐮𝐥𝐝 𝐧𝐨𝐭 𝐡𝐞𝐬𝐢𝐭𝐚𝐭𝐞 𝐚 𝐦𝐨𝐦𝐞𝐧𝐭 𝐭𝐨 𝐩𝐫𝐞𝐟𝐞𝐫 𝐭𝐡𝐞 𝐥𝐚𝐭𝐭𝐞𝐫. He added, “social media is just growing and growing. It is part of our problem…in terms of building consensus around any issue. It’s really hard to govern today. The referees we used to have to determine what is a fact and what isn’t a fact have kind of been eviscerated… and people go and self-select where they go for their news, for their information… [Social media sources of information] are sick, and, you know, have an agenda and they’re putting out disinformation..” https://t.ly/0LfPW Kerry wants to “hammer out of existence” the First Amendment because “social media is growing and growing” and providing people independent outlets of information outside the command and control of the New World Order elites and his buddies in the Deep State. People are seeking alternative sources of information because they are sick and tired of the lies and fake news of the corporate state media masquerading as private independent media and propagating lies, boldfaced lies and damned lies ceaselessly.

𝐊𝐞𝐫𝐫𝐲 𝐰𝐚𝐧𝐭𝐬 𝐭𝐨 𝐞𝐬𝐭𝐚𝐛𝐥𝐢𝐬𝐡 𝐚 𝐏𝐨𝐥𝐢𝐜𝐞 𝐓𝐡𝐨𝐮𝐠𝐡𝐭 𝐂𝐨𝐧𝐭𝐫𝐨𝐥 𝐅𝐨𝐫𝐜𝐞 𝐛𝐲 𝐡𝐚𝐦𝐦𝐞𝐫𝐢𝐧𝐠 𝐭𝐡𝐞 𝐅𝐢𝐫𝐬𝐭 𝐀𝐦𝐞𝐧𝐝𝐦𝐞𝐧𝐭 𝐨𝐮𝐭 𝐨𝐟 𝐞𝐱𝐢𝐬𝐭𝐞𝐧𝐜𝐞 𝐚𝐧𝐝 𝐞𝐧𝐬𝐮𝐫𝐢𝐧𝐠 𝐭𝐡𝐞 𝐝𝐨𝐦𝐢𝐧𝐚𝐧𝐜𝐞 𝐨𝐟 𝐭𝐡𝐞 𝐯𝐢𝐞𝐰𝐬 𝐨𝐟 𝐃𝐞𝐦𝐨𝐧𝐊𝐫𝐚𝐭𝐬. Kerry can neither fathom nor tolerate, and indeed finds downright hateful the very idea of ordinary people exercising their brain power to seek out information from diverse sources and exchange it among themselves.

𝐊𝐞𝐫𝐫𝐲 𝐢𝐬 𝐭𝐞𝐫𝐫𝐢𝐟𝐢𝐞𝐝 𝐚𝐭 𝐭𝐡𝐞 𝐩𝐫𝐨𝐬𝐩𝐞𝐜𝐭 𝐭𝐡𝐚𝐭 𝐨𝐫𝐝𝐢𝐧𝐚𝐫𝐲 𝐩𝐞𝐨𝐩𝐥𝐞 𝐚𝐫𝐞 𝐬𝐩𝐢𝐭𝐭𝐢𝐧𝐠 𝐚𝐧𝐝 𝐭𝐮𝐧𝐢𝐧𝐠 𝐨𝐮𝐭 𝐭𝐡𝐞 𝐟𝐚𝐤𝐞 𝐧𝐞𝐰𝐬 𝐚𝐧𝐝 𝐜𝐮𝐫𝐚𝐭𝐞𝐝 𝐩𝐫𝐨𝐩𝐚𝐠𝐚𝐧𝐝𝐚 𝐭𝐡𝐞y 𝐚𝐫𝐞 𝐟𝐞𝐝 𝐛𝐲 𝐡𝐢𝐬 𝐍𝐞𝐰 𝐖𝐨𝐫𝐥𝐝 𝐎𝐫𝐝𝐞𝐫 𝐞𝐥𝐢𝐭𝐞𝐬 𝐚𝐧𝐝 𝐛𝐮𝐝𝐝𝐢𝐞𝐬 𝐢𝐧 𝐭𝐡𝐞 𝐃𝐞𝐞𝐩 𝐒𝐭𝐚𝐭𝐞. 𝐇𝐞 𝐛𝐞𝐥𝐢𝐞𝐯𝐞𝐬 𝐢𝐭 𝐢𝐬 𝐭𝐡𝐞 𝐝𝐢𝐯𝐢𝐧𝐞 𝐫𝐢𝐠𝐡𝐭 𝐨𝐟 𝐡𝐢𝐬 𝐃𝐞𝐦𝐨𝐧𝐊𝐫𝐚𝐭𝐬 𝐭𝐨 𝐬𝐩𝐨𝐨𝐧-𝐟𝐞𝐞𝐝 𝐀𝐦𝐞𝐫𝐢𝐜𝐚𝐧𝐬 𝐟𝐚𝐤𝐞 𝐧𝐞𝐰𝐬 𝐚𝐧𝐝 𝐜𝐮𝐫𝐚𝐭𝐞𝐝 𝐩𝐫𝐨𝐩𝐚𝐠𝐚𝐧𝐝𝐚 𝐛𝐲 𝐭𝐡𝐞 𝐜𝐨𝐫𝐩𝐨𝐫𝐚𝐭𝐞 state 𝐦𝐞𝐝𝐢𝐚.

Kerry is perplexed he cannot build consensus on his New World Order agenda. But what frustrates and puzzles him is the inability and paralysis of his DemonKrats and his New World Order buddies to “manufacture consent and consensus,” as Noam Chomsky has brilliantly demonstrated. Kerry says it is “hard to govern today.” What he really means is that social media has created mechanism of accountability and demands for transparency he simply cannot live with. Every Tom, Dick, Harry and Jane is asking questions about government corruption, waste, fraud and abuse.

Ordinary citizens are holding their politicians’ feet to the fire. Kerry hates that. 𝐇𝐞 𝐰𝐚𝐧𝐭𝐬 𝐭𝐨 𝐩𝐚𝐭𝐫𝐨𝐧𝐢𝐳𝐢𝐧𝐠𝐥𝐲 𝐚𝐧𝐝 𝐜𝐨𝐧𝐝𝐞𝐬𝐜𝐞𝐧𝐝𝐢𝐧𝐠𝐥𝐲 𝐩𝐫𝐞𝐚𝐜𝐡 𝐭𝐡𝐞 𝐆𝐨𝐬𝐩𝐞𝐥 𝐨𝐟 𝐭𝐡𝐞 𝐃𝐞𝐦𝐨𝐧𝐊𝐫𝐚𝐭𝐬 𝐭𝐨 𝐭𝐡𝐞 𝐦𝐚𝐬𝐬𝐞𝐬 𝐟𝐫𝐨𝐦 𝐡𝐢𝐬 𝐥𝐨𝐟𝐭𝐲 𝐏𝐚𝐧𝐭𝐡𝐞𝐨𝐧𝐬 𝐢𝐧 𝐖𝐚𝐬𝐡𝐢𝐧𝐠𝐭𝐨𝐧, 𝐃𝐂. Maximilien Robespierre, a controversial figure of the French Revolution said, “The secret of freedom lies in educating people, whereas the secret of tyranny is in keeping them ignorant.”

Kerry wants his DemonKrats and New World Order buddies to “educate” the people using the corporate media and keep them dumb and stupid. He does not want the people to educate themselves by searching out information on their own or exchanging it with their fellow citizens. 𝐇𝐢𝐬 𝐛𝐞𝐥𝐢𝐞𝐟 𝐚𝐬 𝐚 𝐃𝐞𝐦𝐨𝐧𝐊𝐫𝐚𝐭, 𝐬𝐩𝐨𝐫𝐭𝐢𝐧𝐠 𝐭𝐡𝐞 𝐥𝐨𝐠𝐨 𝐨𝐟 𝐚 𝐝𝐨𝐧𝐤𝐞𝐲, 𝐢𝐬 𝐭𝐡𝐚𝐭, “𝐓𝐡𝐞 𝐦𝐚𝐬𝐬𝐞𝐬 𝐚𝐫𝐞 𝐝𝐮𝐦𝐛 𝐚𝐬𝐬𝐞𝐬.”

Kerry says social media is “putting out disinformation.” Biden created a Disinformation Governance Board to provide guidance to federal agencies “on combating misinformation, malinformation, and disinformation.” That is not enough for Kerry. The First Amendment must be hammered out of existence. Kerry says social media is “sick” because it gives access of expression to the little guy and gal to engage in the democratic process.

𝐖𝐡𝐚𝐭 𝐢𝐬 𝐬𝐢𝐜𝐤 𝐢𝐬 𝐭𝐡𝐞 𝐟𝐚𝐜𝐭 𝐭𝐡𝐚𝐭 𝐨𝐫𝐝𝐢𝐧𝐚𝐫𝐲 𝐀𝐦𝐞𝐫𝐢𝐜𝐚𝐧𝐬 𝐚𝐫𝐞 𝐬𝐢𝐜𝐤 𝐚𝐧𝐝 𝐭𝐢𝐫𝐞𝐝 𝐨𝐟 𝐛𝐞𝐢𝐧𝐠 𝐬𝐢𝐜𝐤 𝐚𝐧𝐝 𝐭𝐢𝐫𝐞𝐝 𝐨𝐟 𝐭𝐡𝐞 𝐟𝐚𝐤𝐞 𝐧𝐞𝐰𝐬 𝐚𝐧𝐝 𝐩𝐫𝐨𝐩𝐚𝐠𝐚𝐧𝐝𝐚 𝐩𝐞𝐫𝐩𝐞𝐭𝐫𝐚𝐭𝐞𝐝 𝐚𝐧𝐝 𝐜𝐨𝐨𝐫𝐝𝐢𝐧𝐚𝐭𝐞𝐝 𝐞𝐯𝐞𝐫𝐲 𝐝𝐚𝐲 𝐛𝐲 𝐭𝐡𝐞 𝐍𝐘 𝐓𝐢𝐦𝐞𝐬, 𝐓𝐡𝐞 𝐖𝐚𝐬𝐡𝐢𝐧𝐠𝐭𝐨𝐧 𝐏𝐨𝐬𝐭, 𝐂𝐍𝐍, 𝐍𝐏𝐑, 𝐅𝐨𝐱 𝐚𝐧𝐝 𝐫𝐞𝐬𝐭.

What is truly shocking is the fact that Kerry, an attorney, should reflexively prefer to take a sledgehammer to the First Amendment. Unless Kerry is the dumbest lawyer in America, he must know the First Amendment is the repository of a bundle of rights. “Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” It is this First Amendment which guarantees freedom of religion, freedom of speech, freedom press, freedom to peaceably assemble and the freedom to petition government for redress of grievances that Kerry wants to “hammer out of existence.”

Kerry wants to take a sledgehammer and put out of existence these precious bundle of liberties. The Founders of the American Republic made clear their intention to protect and put beyond the reach of government regulation the essential and non-negotiable natural rights of Americans using the simplest and clearest expression of the English language. “𝐂𝐨𝐧𝐠𝐫𝐞𝐬𝐬 𝐬𝐡𝐚𝐥𝐥 𝐦𝐚𝐤𝐞 𝐧𝐨 𝐥𝐚𝐰…” 𝐖𝐡𝐢𝐜𝐡 𝐩𝐚𝐫𝐭 𝐨𝐟 𝐭𝐡𝐢𝐬 “𝐧𝐨 𝐥𝐚𝐰” 𝐩𝐡𝐫𝐚𝐬𝐞 𝐝𝐨𝐞𝐬 𝐊𝐞𝐫𝐫𝐲 𝐧𝐨𝐭 𝐮𝐧𝐝𝐞𝐫𝐬𝐭𝐚𝐧𝐝. Why did the Founders/Framers of the US Constitution choose such sweeping language as “Congress shall make no law…”

Again, unless Kerry is the dumbest lawyer in America, he must know that the First Amendment is enshrined as a “preferred freedom.” It ranks at the very top of the hierarchy of American constitutional values. Any attempt by Congress to limit First Amendment freedoms is denied the usual presumption of constitutionality and is subjected to strict scrutiny by the judiciary. Strict scrutiny is the most rigid constitutional standard of judicial review used to determine whether government action or legislation violates constitutional rights.

Only under the most extreme circumstances can rights guaranteed under the First Amendment be curtailed. Kerry is not the first loser politician to advocate the destruction of the First Amendment. Wars, threats of wars, and perceived risks to national security have prompted Congress to restrict restrict freedom of speech and other First Amendment freedoms. In 1798 the Federalist Congress adopted the Sedition Act, presumably to prevent threats to national security from internal dissenters. Its real aim was to stifle any speech that criticized the president.

During the Civil War, the federal government (Union generals) jailed newspaper reporters and other critics in the name of preventing moral support for the rebels and preventing them from disseminating military information and discouraging enlistments. During World War I, Congress adopted the Espionage Act of 1917 and the Sedition Act of 1918 in the name of national security and justify restrictions on free speech. The US Supreme Court went along with Congress finding the speech presented a clear and present danger to national security and war efforts. These cases were later overruled or their precedential significance ignored.

During World War II and the Cold War that followed, Congress adopted the Smith Act that made it illegal to call for the overthrow of the U.S. government and allowed intrusive congressional investigations into personal beliefs and associations in an effort to suppress domestic communists in America. Opposition to U.S. involvement in the Vietnam War resulted in multiple Supreme Court cases affirming freedom of speech. In the end, efforts by Congress to regulate free speech and press could not pass constitutional muster. The First Amendment freedoms are fundamental principles of liberty and justice which lie at the base of all American civil and political institutions.

The First Amendment is the most precious of all American rights. It is the “the matrix, the indispensable condition, of nearly every other form of freedom.” It is this First Amendment Kerry wants to stamp out of existence! Because Kerry hates disinformation, he wants to take a sledgehammer to the First Amendment. Kerry wants throw out the baby with the bathwater.

𝐈𝐭 𝐰𝐢𝐥𝐥 𝐛𝐞 𝐭𝐡𝐞 𝐋𝐚𝐧𝐝 𝐨𝐟 𝐅𝐚𝐬𝐜𝐢𝐬𝐦 𝐚𝐧𝐝 𝐅𝐞𝐚𝐫, 𝐚𝐧𝐝 𝐇𝐨𝐦𝐞 𝐨𝐟 𝐭𝐡𝐞 𝐂𝐨𝐰𝐚𝐫𝐝 𝐚𝐧𝐝 𝐁𝐫𝐨𝐰𝐛𝐞𝐚𝐭𝐞𝐧. The late US Supreme Court Associate Justice William O. Douglas, the longest-serving justice in the history of the US Supreme Court and passionate defender of American liberties, observed, “Restriction of free thought and free speech is the most dangerous of all subversions. It is the one un-American act that could most easily defeat us.” Douglas also warned, “I do not know of any salvation for society except through eccentrics, misfits, dissenters and people who protest.”

I wholeheartedly agree. All the nobodies, eccentrics, misfits, dissenters and protestors on social media are the salvation of America, not its doom as Kerry believes. Kerry knows, “The pen is mightier than the sword.” He knows the written word is more effective than violence as a means of social or political change. People are exchanging ideas on social media and Kerry does not know how he can stop them or fight people information power.

Kerry is scared because he knows there is nothing is more powerful than an idea whose time has come. He knows nothing is more powerful than ordinary citizens who can think for themselves and refuse to be spoon-fed lies and fake news by the DemonKrats and Deep State. Kerry thinks he is an American Hero for his service in Vietnam, but in America today by publicly arguing for stamping out of existence the Frist Amendment, he has become an America Zero. I have spent over three decades of my life teaching the US Constitution in the classroom and defending it in the courtroom and the court of public opinion. What is the big deal about the U.S. Constitution? The US Constitution with its 27 amendments is an extraordinary document that set limits on the authority and power of government and maximize individual liberty. It creates a simple but brilliant system of separation of powers, an independent judiciary and a system of checks and balances between branches of government. During my lifetime, I have taken numerous oaths to protect and defend the US Constitution.

When I became a member of the United States Supreme Court Bar, I took a solemn oath: “I DO SOLEMNLY SWEAR THAT AS AN ATTORNEY AND AS A COUNSELOR OF THIS COURT I WILL CONDUCT MYSELF UPRIGHTLY AND ACCORDING TO LAW, AND THAT I WILL SUPPORT THE CONSTITUTION OF THE UNITED STATES.” Defending the First Amendment against all enemies domestic and foreign is an inviolable oath I have taken.

When the late Meles Zenawi, the ruthless leader of the woyane/Tigray Peoples Liberation Front in Ethiopia, came to speak at Columbia University in September 2010, I rose to defend his right to speak. Truth be told, I have defended many clients whose ideas and actions I find utterly repulsive and reprehensible. Why? Because the US Constitution dictates, “No person shall be deprived of life, liberty or property without due process of law. The First Amendment is the most cherished of all American liberties and they will have to go through me before they hammer it out of existence. I agree with Noam Chomsky’s maxim: “If we don’t believe in freedom of expression for people we despise, we don’t believe in it at all.” I am now retired from active practice of law. I can write and express myself to my heart’s content on any topic I want because I am fully shielded and armored by the First Amendment. I have challenged and criticized every American president, secretary of state and untold numbers of US Senators and members of Congress over the past three decades because I was/am confident in the protective power and unassailable majesty of the First Amendment. Because of the First Amendment I can tell Joe Biden, “Let’s go Brandon!” I can call the leaders of the US democrat party DemonKrats because I am protected by the First Amendment.

I can proclaim to the world the DemonKrats are an existential threat to America because I am protected by the First Amendment. It was in 1968, in Vietnam, in the town of Ben Tre, where a fierce battle had taken place between the Vietcong and American troops. A US Army major was asked why so much force was used to destroy Ben Tre. The major replied, Ben Tre was so infiltrated by Vietcong, “It became necessary to destroy the town to save it.” Kerry served in Vietnam as a Lieutenant in the United States Navy during the period from 1966 to 1970.

His warped logic is, “There is so much disinformation on social media, it is necessary to put the First Amendment out of existence to save it.” In his message to Congress in 1862, Abreham Lincoln said: “The world will not forget that we say this. We know how to save the Union. The world knows we do know how to save it. We – even we here – hold the power and bear the responsibility.
